Agreement for the provision of parental control and family communication services
Nikolenko Evgeniya Alekseevna, self-employed (professional income tax payer), hereinafter the “Service Provider”, offers an adult individual with full legal capacity, hereinafter the “User”, an agreement for the provision of FamilyGuard services for personal and family needs on the following terms. Details of the Service Provider are set out in section 12.
1 Terms and documents
1.1. FamilyGuard, or the Service, is an Android mobile application for parental control and family communication, together with its related software and server components. Parent and child roles may be used in the same application on different devices.
1.2. A Family is a group of linked accounts and devices belonging to parents, other legal representatives and children. Another adult member may be added with that person's consent. The presence of a device in the group does not in itself confirm a family relationship or a representative's authority.
1.3. A Subscription provides access to a specified set of services for a paid period. The plan determines the price, period, number of child and adult devices that may be connected, available features and their limits.
1.4. A Trial Period provides temporary free access to the features specified when it is activated. Free Mode means using the part of the Service available without a subscription on the stated terms.
1.5. The FamilyGuard User Agreement sets out the rules for using the application and connecting devices. The Privacy Policy sets out how personal data are processed. Consent to data processing, where consent is the basis for processing, is obtained separately from this Offer and the User Agreement.
1.6. Links to the current documents: Offer — the “Legal information” section; User Agreement — the “Legal information” section; Privacy Policy — the “Legal information” section; consent to personal data processing — the “Legal information” section. The texts are available before the relevant action is confirmed.
2 Subject matter and conclusion of the agreement
2.1. The Service Provider provides access to the selected FamilyGuard services, and the User pays for them on the terms of the selected plan. Use of Free Mode is governed by the User Agreement and the terms shown in the application.
2.2. Before paid access is ordered, the User is shown the price, set of services, length of the period, limits, trial terms and information about automatic renewal, if offered.
2.3. On first launch, the User may accept the User Agreement and the terms of the Offer using a single checkbox stating “I accept the User Agreement and the terms of the FamilyGuard Offer”. An order for specific services and acceptance of the agreement for their provision occur when the selected plan is paid for after its price and terms have been provided. The initial checkbox does not constitute an order for all paid services. For trial access, acceptance occurs when the activation button is pressed after this confirmation. When the screen opens, the checkbox is shown as selected. The User may deselect it; if it is deselected, the “Continue” button is disabled. The selected checkboxes are confirmed only by explicitly pressing that button.
2.4. Downloading the application, granting a system permission, registering an account or remaining silent do not in themselves constitute an order for a paid subscription or consent to automatic charges.
2.5. The agreement is concluded at the moment of acceptance. The Service Provider records the acceptance of the terms, the User's account, the date and the document version. The User may save the text of the accepted version and request information about their order.
2.6. Acceptance of the Offer does not replace any required consent to personal data processing, confirmation of a legal representative's authority or other grounds for access to information required by law.
3 Services and how they are provided
3.1. Depending on the selected plan and the device's capabilities, the Service provides family messages and calls, geolocation and location history, geofence notifications, battery and connectivity information, phone finding, child commands and an SOS signal, as well as the remote features included in the plan.
3.2. Remote features may include transmitting sounds around the child's device and making audio recordings, obtaining camera photos or videos, screenshots and screen videos, and viewing available media files. The specific capabilities, limits and access conditions are disclosed before payment. The rules for their lawful use are set out in the User Agreement.
3.3. During the free launch period, access is provided after joining a Family. After paid subscriptions are launched, paid access is activated once successful payment is confirmed. The account shows the beginning, end and included services of the paid period. If activation is delayed, the User may contact support; a period that was not activated due to the Service Provider's fault is not treated as having been provided.
3.4. The features require compatible devices, installation of the application, account linking, the necessary permissions and a suitable connection. Information about material compatibility requirements and restrictions is provided to the User before payment.
3.5. Features may depend on the Android version, power-saving settings, internet availability, permissions and device restrictions. If the Service Provider knew of a material restriction, it must be disclosed before purchase. This clause does not remove liability for inaccurate descriptions of services or defects in them.
3.6. Where an SMS channel is available, certain coordinates, signals or commands may be sent by SMS on the terms shown when the feature is enabled. The User pays their carrier separately for internet, SMS, roaming and other communication services. Operation under all network restrictions is not guaranteed.
3.7. SOS signals and other notifications help users contact their family. FamilyGuard is not an emergency response service and does not in itself call the police, an ambulance or other services. In the event of a threat to life or health, the appropriate emergency service should be contacted.
4 Rights and obligations of the User
4.1. The User is entitled to receive the agreed scope of services, view their subscription status, contact support, disable renewal, cancel services and request a refund in the cases provided for by the agreement and the law.
4.2. The User is entitled to receive the information required by law about the processing of their data and the data of the child they represent, request correction or deletion where grounds exist, and withdraw consent if processing is based on consent.
4.3. The User provides accurate information, pays for the selected services, complies with the device connection rules and uses the Service solely on lawful grounds. When connecting a child, the User confirms that they have the authority of a parent or other legal representative.
4.4. The User keeps their password, linking codes and account access secure. If they suspect a compromise, they stop using the compromised access and notify the Service Provider. Liability for a breach is assessed with regard to fault and the circumstances of the incident.
4.5. The User independently checks the rules applicable to their actions and obtains any consents required by law. They may not use FamilyGuard to unlawfully connect other people's devices, obtain other people's correspondence, record or distribute private information, or stalk others.
5 Rights and obligations of the Service Provider
5.1. The Service Provider provides the agreed scope of paid services, communicates material terms before payment, accepts requests, remedies identified defects and takes the measures required by law to protect personal data.
5.2. The Service Provider provides access to subscription information and ways to stop renewal, refuse further use of payment details and request a refund. These actions are available electronically.
5.3. The Service Provider may release updates, address vulnerabilities and carry out maintenance. Where possible, Users are notified in advance of scheduled work that materially affects access. Necessary urgent security measures may be taken without prior notice.
5.4. Where there are reasonable indications of unlawful use, account compromise or a threat to other users, the Service Provider may impose proportionate restrictions on the affected access while investigating. The User is told the reason and how to make a request, unless such notice is prohibited by law or creates a security threat.
5.5. Restricting access does not automatically remove the right to a refund. Monetary claims are considered according to the circumstances and the law; no penalty equal to the entire paid subscription is imposed merely because access has been blocked.
6 Plans, payment and renewal
6.1. Until paid access is launched separately, all FamilyGuard features are provided free of charge. Free access is not limited to seven calendar days and does not automatically become a paid subscription. Each Family may connect up to 3 child devices and 2 adult devices.
6.2. After paid subscriptions are launched, the FamilyGuard base plan costs 200 rubles for one month or 1800 rubles for one year and includes 3 child devices and 2 adult devices. These prices apply only to separately confirmed paid orders. Until paid access is launched, no payment is required and no payment details are requested for charges.
6.3. After paid subscriptions are launched, one package for 5 devices of any type may be ordered in addition to the base set: child or adult devices in the combination chosen by the User. The package costs 100 rubles per month or 900 rubles per year. The total limit, including the base set, is 10 devices. The package renewal date is the same as the base subscription renewal date; if added during a paid period, its price is prorated for the remaining part of that period and shown before the order is confirmed. This package is not available during the free launch period.
6.4. Connected devices are counted, rather than just member accounts: one adult's phone and tablet occupy two slots. A temporarily unavailable device continues to occupy a slot. The Family owner may disconnect an old phone to free a slot for a replacement; the member's profile and data are retained. Camera photos, screenshots, listening, audio recordings and remote video are included in access without monthly limits or separate media package fees. Technical limits for an individual session and the conditions under which features operate are disclosed in the application interface.
6.5. A subscription month runs from the activation date to the corresponding date of the following month, and a year runs to the corresponding date of the following year. If there is no corresponding date, the period ends on the last day of the relevant month. The exact start and end times are shown in the account before payment.
6.6. Payment is made using the methods available on the order screen, through the bank, app store or payment service identified there. Payment confirmation and a fiscal receipt, where required, are provided in the manner prescribed by law.
6.7. Automatic renewal is enabled only through a separate explicit action by the User after the amount, frequency, date of the first charge and cancellation method have been shown. A one-time subscription payment does not in itself constitute consent to subsequent charges.
6.8. Renewal may be disabled in the subscription management section or by an electronic request sent to familyguard.notify@gmail.com. If the subscription was purchased through an app store, instructions for cancelling it in that store are also provided. Disabling renewal preserves access until the end of the period already paid for, unless the User requests that services end earlier.
6.9. The User may refuse further use of previously provided payment details by an electronic request or an available method in the interface. After receiving such a refusal, the Service Provider does not use those details for recurring payments and ensures that the corresponding charges stop to the extent of its obligations.
6.10. A price change does not apply to a period already paid for. The new price is communicated before the next order; an automatic charge at an increased price is permitted only after the User's explicit consent. Without that consent, the price increase does not provide grounds to charge the higher amount.
6.11. If payment fails, a new paid period is not activated. Expiry of the subscription does not in itself create a debt for the next period. Termination of paid access does not constitute consent to another paid offer.
7 Personal data and confidentiality
7.1. Data are processed on an applicable lawful basis in accordance with Federal Law No. 152-FZ of 27 July 2006 and the FamilyGuard Privacy Policy. The Offer is not blanket consent to any and all data processing.
7.2. The Policy discloses the categories of data, purposes, legal bases, retention periods, recipients and processors, applicable data transfer conditions and the procedure for exercising rights. Actual processing and the infrastructure used must comply with that information and the requirements of the law.
7.3. If consent is provided by a child's representative, the Service Provider verifies their authority. The verification method is communicated before data are collected for this purpose; the information requested must be necessary and proportionate to the verification.
7.4. Processing for advertising and mailings that is not necessary to provide the selected services is carried out on an independent lawful basis. Refusal to give optional consents must not prevent receipt of services for which those data are not required.
7.5. A diagnostic log sent to support on the User's initiative is used to investigate the request. The contents of the log, the legal bases for its processing and the retention period are disclosed in the Policy; technical diagnostics do not constitute permission to transmit all correspondence or the entire media library.
7.6. Ending a subscription, deleting an account and withdrawing consent are different actions. Data deletion periods and cases in which continued retention is lawful are disclosed in the Policy. Requests are sent to familyguard.notify@gmail.com.
8 Liability of the parties
8.1. The parties are liable for failure to perform or improper performance of their obligations in accordance with applicable law.
8.2. The User bears the liability prescribed by law for unlawful use of the services or interference with third parties' private lives, including their own actions involving the unlawful connection of devices or obtaining, using or distributing information.
8.3. The User's liability for their own actions does not exclude or limit the Service Provider's liability established by law for its acts or omissions, defects in the services, or violations of data protection and consumer rights.
8.4. The aim of protecting a child does not confer a right to use any method of observation or recording. The Service does not give the User powers they do not have under the law.
8.5. The Service Provider does not promise to prevent every dangerous situation or to deliver every signal continuously under all connection conditions. These technical limitations do not remove the obligation to provide accurate information about services or liability for breaches in the cases established by law.
8.6. Exemption from liability due to force majeure is determined by law. A contractor's failure, shortage of funds or ordinary technical malfunction is not automatically treated as force majeure.
9 Cancellation of services, refunds and requests
9.1. The User may withdraw from the service agreement at any time. Amounts payable or refundable are calculated with regard to Article 32 of the Russian Federation Law “On Protection of Consumer Rights” and other applicable provisions. Any expenses deducted upon cancellation must have actually been incurred, relate to this agreement and be substantiated by the Service Provider.
9.2. To cancel services or request a refund, the User sends a request to support at familyguard.notify@gmail.com or through an available channel in the application. It is sufficient to identify the account, order or payment and state the request. A reason for voluntary cancellation is not a mandatory condition for accepting the request.
9.3. Cancelling future renewal and immediately cancelling the current paid period are different actions. If the User requests termination of current services, the Service Provider does not limit its response to disabling the next charge and considers the calculation of amounts due and any refund for the current period.
9.4. Merely opening the application or being given access does not automatically mean that all services for the entire future period have been provided and is not, on its own, grounds for refusing to refund the full amount.
9.5. In the event of defective services, an unlawful charge or failure to provide paid services, the User retains the claims available under the law. Fees, cancellation penalties and other deductions without a lawful basis do not apply.
9.6. The Service Provider responds to an ordinary request within 10 calendar days. Where the law establishes a specific time limit for a claim or action, that time limit applies. The need to clarify an account or payment is not used to unreasonably delay consideration.
9.7. A refund is made to the original payment method where possible. If a refund by that method is impossible, the parties agree on another lawful method. The involvement of an app store or payment intermediary does not remove the User's mandatory rights or the Service Provider's obligations.
10 Governing law and disputes
10.1. The agreement is governed by the law of the Russian Federation. Mandatory consumer protection provisions that apply to the User by law remain in force.
10.2. The parties may resolve a dispute through correspondence with support. Contacting support does not limit the User's right to judicial protection or establish a mandatory pre-trial procedure unless such a procedure is required by law.
10.3. Jurisdiction is determined by law. A User who is a consumer retains the right to choose a court granted by law; there is no requirement for a dispute to be heard solely at the Service Provider's location.
11 Duration and changes to the terms
11.1. The Offer remains in effect from its publication date until it is withdrawn or replaced for new orders. An agreement that has been concluded remains in effect until its obligations have been performed or it is terminated on lawful grounds.
11.2. A new version applies to new orders after its text has been provided and accepted by the User. It does not reduce the scope of services already paid for, increase the price of a paid period or remove existing rights to a refund or to bring claims.
11.3. A material change to the terms of an existing subscription requires a basis provided for by law and the necessary confirmation from the User. Continued use of the application does not replace new consent to data processing or consent to an increased charge.
11.4. Payment, the scope of ordered services and refunds are governed by the Offer; the rules for using the software are governed by the User Agreement; data processing matters are governed by the Policy and the applicable processing bases. No document takes precedence over mandatory provisions of the law.
11.5. If an individual term is invalid, the other provisions remain in force to the extent permitted by law. An invalid term is not automatically replaced by one that is more burdensome for the User.
