User Agreement
English translation of the Russian documents supplied with the FamilyGuard app
Rules for using the application and connecting devices
This User Agreement sets out the rules for using the FamilyGuard application and related services. Nikolenko Evgeniya Alekseevna, self-employed (professional income tax payer), hereinafter the “Administration”, provides the Service on the terms set out below. Details of the Administration are set out in section 15.
1 Purpose of the Service and participants
1.1. FamilyGuard is intended for family communication and parental control on lawful grounds. The application helps parents and other legal representatives care for a child, obtain available information about a linked device and interact with family members.
1.2. A User is an adult individual with full legal capacity who has accepted the Agreement. Child Mode is used by a child with the involvement of a parent or other legal representative and where the necessary legal bases exist.
1.3. The parent role provides the management and information access features allowed by the settings. The child role is used on the child's linked device. Selecting a role in the application does not create legal authority or in itself confirm a family relationship.
1.4. A Family is a group of linked accounts and devices. Each member's access is determined by their role and settings. Adding another adult, including a second parent, does not remove the need for a lawful basis to provide that person with the relevant data.
1.5. The Service includes the Android application and the software and server components required for its operation. The specific set of features is determined by the application version, plan, device characteristics and explicitly communicated technical limitations.
2 Acceptance of the Agreement and related documents
2.1. On first launch, before using FamilyGuard, the User is provided with links to the Agreement, Offer and Privacy Policy. The User confirms the checkbox “I accept the Offer and User Agreement” by explicitly pressing “Continue”. A separate checkbox confirms consent to personal data processing on the terms of the Consent text available through the link. When the screen opens, both checkboxes are shown as selected. Either checkbox may be deselected; if a checkbox is deselected, the “Continue” button is disabled. Merely displaying the checkboxes does not constitute confirmation. Paid services are ordered separately under the Offer.
2.2. If the User does not accept the Agreement, they do not complete connection to the Service. Merely downloading the application or granting an Android permission does not constitute acceptance of all documents and any future changes.
2.3. The FamilyGuard Offer governs service orders, subscriptions, payment, cancellation of renewal and refunds. The Privacy Policy discloses personal data processing. Consent to data processing, where required as the basis for processing, is obtained separately.
2.4. Acceptance of the Agreement does not constitute consent to advertising mailings, automatic payments or processing of data unrelated to the selected features. Such actions require their own legal basis and appropriate formalities as provided for by law.
2.5. The Administration records the version of the Agreement and its acceptance. The User may save the text and request information about the version they accepted.
3 Account and device connection
3.1. The User provides accurate information, maintains access to their email address or other sign-in method used, and protects their credentials from outsiders.
3.2. A child's device is connected through the linking mechanism provided by the application and setup on the device itself. Access to an email account, code or phone confirms the corresponding technical access and does not in itself prove a family relationship.
3.3. When connecting a child, the User confirms that they are the child's parent or other legal representative and have the necessary authority. When obtaining consent from a representative, the Administration verifies their authority; the procedure and required information are communicated when such consent is obtained.
3.4. Before use, the User must explain the application's purpose and the nature of the features being connected to the child in an age-appropriate way. The required consents and processing bases are determined by applicable law, taking into account the child's age, legal capacity, the nature of the data and the child's rights.
3.5. An adult's device may be connected only with that person's voluntary informed consent and on terms consistent with the purpose of the Service. Another person's device may not be connected using their credentials, deception or unauthorized access.
3.6. Linking codes, passwords and access to a parent account must not be published or shared with outsiders. If Family membership changes, a device is lost or access is compromised, the User must check the member list and end unnecessary access through an available method or support.
4 FamilyGuard features
4.1. Geolocation and geofences. The Service may show the location of a linked device, location history, address, movement information and events when it enters or leaves specified zones. This information relates to the device and may be inaccurate, delayed or unavailable due to technical limitations.
4.2. Family communication. Private and family chats, voice messages, photos, videos, and audio and video calls are used by members of a linked Family. When sending materials to a chat, the User considers the recipients and whether a lawful basis exists for transferring data about other people.
4.3. Sound around the device. Where this feature, the necessary settings and legal bases are available, a parent may remotely initiate transmission of sound from the child's device microphone and creation of an audio recording within the established limits. This feature provides access to ambient sound and differs from a conversation with the child in which the parent participates.
4.4. Camera and screen. Features included in the application version allow requests for camera photos or videos, screenshots or screen videos from the linked child's device. They are used with the necessary permissions and mandatory operating system confirmations. Access may end or require permission again after a restart or a change in settings.
4.5. Media files and other device data. Viewing, downloading and deleting available files, as well as access to other supported information, are permitted only within an explicitly described feature, the necessary permissions and lawful authority. Linking a device does not create an unconditional right to all data on that device or third parties' correspondence.
4.6. Phone finding and child signals. Device finding, family commands, “I'm okay”, “Call me”, “Pick me up”, “Accompany me” and SOS messages transmit the relevant event through an available communication channel. Receipt and acknowledgement of an event by a parent depend on device and connection availability. Help does not arrive automatically.
4.7. Backup communication. If an SMS channel is supported, certain messages, coordinates or commands may be transmitted through it after the relevant feature is enabled. SMS, mobile communication and roaming costs are determined by the User's carrier. A backup channel does not mean that all media features and calls are available.
4.8. Diagnostics. The User may send a diagnostic log to support to investigate a problem. Sending a log through this action does not constitute permission to continuously send any and all device data. Automatic technical events, if processed, are disclosed separately in the Privacy Policy.
4.9. Features are provided in the set available for the particular order. A feature's inclusion in the general description of the Service does not mean it is supported on every model or included in every plan. Material limitations must be communicated before purchase.
5 Lawful use and the User's liability
5.1. The User uses FamilyGuard solely on lawful grounds and within their authority. The Service's purpose of protecting a child does not remove the child's or other people's rights to privacy or other protections under the law.
5.2. The User obtains the consents required by law and ensures that other applicable bases exist for obtaining, using and transferring information. A legal representative's consent on behalf of a child does not replace consent on behalf of an unrelated person where that person's own consent is required to process their data.
5.3. Unlawful surveillance and recording, unauthorized access to devices and accounts, obtaining other people's correspondence, stalking, blackmail and distribution of information in violation of its holders' rights are prohibited.
5.4. The User may not bypass mandatory permissions, confirmations, system notifications or operating system security restrictions. Features must be used within the capabilities made available to the application and applicable law.
5.5. Access to recordings and other materials is granted only to persons who have an appropriate basis for access. Posting a recording online, forwarding it to outsiders or using it for other purposes requires an independent assessment of lawfulness; obtaining a recording does not confer an unrestricted right to distribute it.
5.6. The User bears the liability prescribed by law for unlawful use of the services or interference with third parties' private lives, including their own actions involving the unlawful connection of devices or obtaining, using or distributing information.
5.7. These terms do not exclude or limit the liability established by law of the Administration and the personal data operator for their own acts or omissions.
6 Device permissions and settings
6.1. Certain features may require geolocation, microphone, camera, notifications, access to selected files and other special Android capabilities. The purpose of each requested access permission must be explained when the relevant feature is configured.
6.2. An Android permission enables technical access. It does not replace any required legal consent or other lawful processing basis. Acceptance of the Agreement likewise does not remove the need for a system permission.
6.3. The User may manage permissions through Android and the available FamilyGuard settings. Disabling access may make a feature that depends on it unavailable, but does not constitute automatic consent to disable other independent features.
6.4. Background operation may depend on auto-start, power-saving settings and device manufacturer restrictions. The application does not confer a right to bypass mandatory Android safeguards.
6.5. If a necessary permission is absent, a system capture session ends or the device is unavailable, actual remote access is unavailable or limited. Access status information should be assessed with regard to when it was last updated.
7 Personal data and Family materials
7.1. Depending on the features enabled, account and device information, family links, geolocation, events, messages, sound, photos, videos, screenshots and technical diagnostics may be processed. The specific data, purposes, legal bases, periods and recipients are disclosed in the Privacy Policy.
7.2. Data must be used to the extent necessary for the stated purposes. Storage on devices and servers, transfers to contractors and deletion are governed by the Policy and the actual organization of the Service in compliance with the law.
7.3. The User retains their rights to materials they create. Sending them through the Service permits the technical processing necessary for the selected feature within the relevant legal basis and does not give the Administration the right to use family recordings in advertising.
7.4. Withdrawal of consent, requests for data deletion and termination of Family membership are submitted through an available method in the application or using the Administration's contact details. The consequences for features and cases of lawful continued processing are disclosed in the Policy. Cancelling a subscription does not in itself constitute a request to delete an account.
7.5. Advertising mailings and optional advertising processing are not automatically included in acceptance of the Agreement. Required consent is obtained separately; refusal does not prevent use of features that do not require such processing.
8 Software rights
8.1. Subject to compliance with the Agreement, the User is granted a simple, non-exclusive, non-transferable license to install and use a lawfully obtained version of FamilyGuard on linked devices for personal and family needs. Paid server services are provided on the terms of the Offer and the selected plan.
8.2. The license remains in effect during lawful use of the application within the number of devices and features provided for in the access terms. It does not transfer exclusive rights to the software, interface, branding or the Administration's materials.
8.3. Without the rights holder's permission, copies of the software may not be sold, the software may not be presented as one's own product, modified versions may not be distributed, commercial access may not be provided to outsiders, and FamilyGuard branding may not be used in a way that creates an impression of an official partnership.
8.4. Restrictions on analyzing, reproducing and modifying the software apply to the extent permitted by law. The Agreement does not prohibit actions expressly permitted by law for a lawful user of the software.
8.5. Maps, software libraries and other third-party components may have their own licenses and terms. Information about them is provided in the application or documentation. Such terms do not remove the User's mandatory rights in relation to the Administration.
9 Free access and paid services
9.1. Some features may be provided free of charge, including with advertising in Parent Mode. The scope of free access is communicated in the application. Subscription details, the trial period, additional children and packages are determined by the Offer and the order screen.
9.2. Acceptance of the Agreement alone does not create an obligation to pay for a subscription. Paid access and automatic renewal require the separate order confirmation specified for them.
9.3. The end of a paid period terminates paid access on the terms of the Offer. It does not create a debt for future periods that have not been ordered or remove the right to request data or exercise other legal rights.
10 Technical limitations and child safety
10.1. Geolocation and notifications may be delayed due to connectivity, device settings, the characteristics of coordinate determination or the phone's condition. A displayed point is not proof of the child's exact location at the current second.
10.2. Message delivery, starting a call and access to the camera, microphone and screen depend on device functionality and the necessary permissions. The Service does not guarantee uninterrupted operation under all network restrictions or on all equipment.
10.3. FamilyGuard assists with family communication and supervision but does not replace caring for a child or contacting emergency services. If there are grounds to believe a child is in danger, the User must not rely solely on the application's status or notification.
10.4. These limitations do not release the Administration from liability for inaccurate descriptions of features, breach of agreed terms, defects in the Service or other violations for which liability is established by law.
11 Support and updates
11.1. Requests are sent through an available support channel in the application or to familyguard.notify@gmail.com. Diagnostics may require the device model, application version, event time and a log relevant to the problem.
11.2. Support requests only information necessary for the request. The User must not send their account password, sign-in codes or full payment instrument details in correspondence with support.
11.3. Updates may change the interface, fix errors and improve security. Material compatibility requirements and changes to paid services are disclosed in the manner established by the Offer and the law.
11.4. Ordinary requests are considered within 10 calendar days. For claims, personal data requests and other actions with a specific statutory time limit, that time limit applies.
12 Restriction of access and account deletion
12.1. Where there are indications of account compromise, unlawful use or a security threat, the Administration may impose proportionate restrictions on the affected access while investigating. The User is told the reason and how to make a request when permitted by law and security conditions.
12.2. The User may challenge the restriction through support and provide information relevant to the investigation. A restriction does not in itself prove a violation or remove the right to have monetary claims considered under the Offer.
12.3. The User may stop using the Service, disconnect devices and request account deletion through an available method. Before deletion, they should save any necessary materials and check the subscription status.
12.4. Deleting the application from a phone does not in itself cancel a subscription created through a payment service or app store. The cancellation procedure is disclosed at purchase and in subscription management. Support accepts electronic requests to cancel services and charges within the scope of the Administration's obligations.
12.5. Data are deleted in accordance with the Policy and the law, taking into account mandatory retention periods and other members' rights to their own materials. These provisions do not confer a right to retain data without a valid basis.
13 Liability of the Administration and the User
13.1. Liability is determined by law, the Agreement and the Offer to the extent permitted by law. The User is liable for their own unlawful actions, and the Administration for its own violations and the obligations imposed on it by law.
13.2. The Agreement does not provide for a complete exemption of the Administration from liability or limit mandatory liability to the amount of the last payment or the cost of the subscription.
13.3. When assessing the consequences of lost access, sharing a code or another member's actions, the circumstances, the parties' fault and applicable security requirements are taken into account. Use of an account does not in itself automatically prove its owner's fault.
13.4. Losses, refunds, remedies for defects and other claims are considered in accordance with the law. No unconditional penalties are imposed for making a complaint, cancelling services or exercising personal data rights.
14 Changes to the Agreement and disputes
14.1. The current text is posted in the “Legal information” section and is available in the application. A new version is communicated before it applies; the necessary confirmation from the User is obtained for material changes to existing terms.
14.2. A new version does not reduce the scope of services already paid for, impose liability retroactively or replace separate consent to new data processing purposes or new payments.
14.3. The User may stop using the Service if they do not accept the proposed new terms. Monetary consequences are determined by the Offer and the law; disagreement with a new version does not in itself remove the right to a refund or to bring claims.
14.4. The law of the Russian Federation applies, while preserving the mandatory guarantees that apply to the User by law. Disputes may be resolved through support or a court in the manner established by law. The consumer's right to choose a court is not restricted.
14.5. The Agreement governs use of the software; the Offer governs ordering and payment for services; the Policy governs data processing within applicable law. The invalidity of one provision does not invalidate the other permissible provisions or restrict the User's mandatory rights.
